Terms of Use

These Terms of Use are an agreement between you and Total Image Care, Inc., doing business as Pia Esthetics Day Spa (“Pia,” “we,” “us” or “our”). They govern your use of bypia.com and Pia-controlled booking, shopping, account, form and other online services that link to these Terms, together called the “Website.”
Please read these Terms before using the Website. When the Website clearly tells you that clicking a button, checking a box, creating an account, making a purchase or completing a booking means you agree to these Terms, that action constitutes your acceptance. Merely displaying a link to these Terms does not replace any affirmative acceptance required at a transaction step.
Eligibility
You must be able to enter into a legally binding agreement to make a purchase or booking through the Website. If you act for another person or organization, you represent that you have authority to bind that person or organization for the transaction.
Website information
We try to keep Website information accurate and current. Service descriptions, prices, staff availability, appointment times, promotions and other content may change. A typographical or technical error does not require us to honor an incorrect price or unavailable offer, but we will provide any refund or other remedy required by law.
Website content is general information and is not medical advice, diagnosis or treatment. Contact an appropriate licensed healthcare professional about a medical condition or whether a service is suitable for you.
Booking, purchases and separate policies
Bookings, purchases, gift cards, promotions, cancellations, late arrivals, no-shows, returns and refunds may be subject to additional terms shown during the transaction or in our Booking Policies. Those transaction-specific terms become part of the agreement when you accept them.
If these Terms conflict with a clearly identified transaction-specific term, the transaction-specific term controls for that transaction.
Accounts and security
You are responsible for information submitted through your account and for keeping your credentials confidential. Notify us promptly if you believe an account or transaction has been used without authorization. Do not attempt to access another person’s account.
Acceptable use
You may use the Website for lawful personal or business interactions with Pia. You may not:
- interfere with the Website, its security or another person’s use
- introduce malicious code or attempt unauthorized access
- scrape, harvest or collect personal information without permission
- use automated systems in a manner that unreasonably burdens the Website
- impersonate another person or submit false transaction information
- copy, republish or commercially exploit Website content except as permitted by law or written permission
- use the Website for fraud, harassment or unlawful activity
We may restrict access when reasonably necessary to protect users, systems, rights or legal obligations.
Reviews and submissions
You retain ownership of original content you submit. When you submit content for public display, such as a review, you give Pia a nonexclusive, worldwide, royalty-free license to host, reproduce, format and display it for operating and promoting Pia, subject to our Privacy Policy and applicable law.
Do not submit confidential information, content you do not have the right to use, or content that is unlawful, defamatory, threatening, deceptive or invasive of another person’s privacy. We may moderate or remove public submissions, but we do not promise to review every submission.
Intellectual property
The Website’s design, text, photographs, graphics, logos, software and other content are owned by or licensed to Total Image Care, Inc. and are protected by applicable copyright, trademark and other laws.
Pia Esthetics, Pia Esthetics Day Spa and associated logos and branding may not be used in a way that suggests sponsorship, endorsement or affiliation without written permission.
You may view and make a reasonable personal copy of Website content for noncommercial use. No other license is granted.
Third-party services and links
The Website may connect to payment processors, booking tools, maps, social networks and other third-party services. Their terms and privacy policies govern their services. We are not responsible for content or conduct that we do not control, but this does not limit any responsibility that applicable law does not allow us to exclude.
Privacy and cookies
Our Privacy Policy explains how we process personal information. Our cookie controls allow you to accept, reject or manage optional analytics and marketing technologies. Accepting cookies is separate from accepting these Terms.
Accessibility
We work to make the Website accessible. If a barrier prevents you from obtaining information, booking or using a feature, use our accessibility request form, email terms@bypia.com with the subject “Accessibility Request” or call 813.831.2418 so we can provide assistance and investigate the issue. Review our Accessibility Statement for more information.
Disclaimer of warranties
To the fullest extent permitted by law, the Website is provided “as is” and “as available.” We do not promise that every feature will always be uninterrupted, error-free or compatible with every device. This disclaimer applies to the Website and does not waive any warranty or consumer right that cannot legally be waived.
Limitation of liability
To the fullest extent permitted by law, Total Image Care, Inc. and its owners, employees and agents will not be liable for indirect, incidental, special, consequential or punitive damages arising solely from use of, or inability to use, the Website.
For a claim arising solely from the Website, our total liability will not exceed the greater of $100 or the amount you paid through the Website for the transaction giving rise to the claim.
These limitations do not apply to gross negligence, intentional misconduct, personal injury caused by a spa service, fraud, a data-security obligation that cannot be limited, or any liability that applicable law does not permit us to limit.
Informal resolution of Website disputes
Before filing a lawsuit concerning the Website or these Terms, the person asserting the claim must send Pia a written notice containing:
- the person’s full name and contact information
- the Website page, feature or transaction involved
- a description of the facts and legal basis of the claim
- the requested resolution
- documents reasonably needed to understand the claim

The parties will attempt in good faith to resolve the matter for 30 days after Pia receives a complete notice. A legal limitations period is paused during this 30-day process to the extent permitted by law.
Mediation
If a Website dispute is not resolved during the 30-day informal process, the parties agree to participate in one good-faith mediation session before filing suit. The mediation may occur remotely or in Hillsborough County, Florida, before a mutually agreed neutral mediator.
For an individual consumer claim, Pia will pay the mediator’s fee for the first two hours. Each party will pay its own attorney fees and other expenses unless a settlement, court order or applicable law provides otherwise.
If the parties cannot agree on a mediator within 10 days after mediation is requested, if a party refuses to participate, or if mediation is not completed within 45 days after the request, the mediation requirement is satisfied.
Small claims
After completing the 30-day informal process, either party may bring an eligible individual monetary claim in the appropriate Florida small claims court without completing private mediation. The claim must remain individual and within that court’s jurisdiction.
Court venue and governing law
A Website dispute that is not resolved through the required process and does not proceed in small claims court must be filed in a state court with jurisdiction in Hillsborough County, Florida, or in the United States District Court for the Middle District of Florida, Tampa Division. Each party consents to personal jurisdiction and venue there, subject to any nonwaivable right under applicable law.
Florida law governs these Terms without regard to conflict-of-law rules, except where federal law or another nonwaivable law applies.
Exceptions to the dispute process
The informal-resolution and mediation provisions do not:
- prevent either party from requesting urgent temporary relief needed to prevent immediate harm
- prevent a person from contacting or filing a complaint with a government agency
- limit a government agency’s authority
- waive a right or remedy that applicable law does not permit the parties to waive
- prevent either party from taking reasonable steps to preserve evidence or a claim before a legal deadline expires
- apply to a claim of copyright or trademark infringement requiring immediate relief
Changes to these Terms
We may update these Terms prospectively. The effective date appears at the top. A material change will not govern a transaction completed before the change unless you affirmatively accept the revised Terms or applicable law allows the change.
Severability and waiver
If a court finds part of these Terms unenforceable, the remaining provisions remain in effect to the extent they can operate without the invalid provision. A failure to enforce a provision once is not a permanent waiver.
